Car Seat Thoughts

First two question - is the 40 lbs limit on harnesses based on weight with or without clothing? Is there any harm in putting a child that's 41-42 lbs in the harness if they still fit in the seat?
On Saturday there is a car seat check being done in our area. I want to have the Graco harnessed booster put in Mark's car to replace the convertible seat (the straps twisted horribly). For my car, I'd like to get a Turbo Booster (no harness). I may or may not switch it on Saturday from the current Graco convertible. I am thinking that I shouldn't have a problem with him wiggling out of it as we usually use my car for very local trips, on longer trips someone is in the back with him. He's actually pretty content in the car, just looks around or sleeps. Also the Turbo booster is much easier to move to another car if we decided to carpool for some reason. I bought the Graco booster we have in a hurry last year - I don't have the instructions, so I'd prefer someone to put it in and leave it in.
My MILs car also has a Graco convertible. I'm wondering if we can leave it in for now (it's in the best condition of the 3 convertibles we have). I'm thinking towards the spring to get a second Turbo booster or other positioning booster. (She is our backup for picking up Alan from daycare, so it's best to leave a seat in her car full time.)
